Agreement to Booking and Liability Waiver
Welcome to Sammy’s Party on Wheels LLC! We’re thrilled to bring unforgettable experiences to your special event. To ensure a smooth and safe experience, please review and agree to the following terms and conditions for booking, liability, and weather policies.
Booking Agreement
By booking an event with Sammy’s Party on Wheels LLC, the client (“Client”) agrees to these terms and acknowledges that this document serves as a legally binding contract. This agreement covers liability, weather policies, setup procedures, and cancellation terms.
Liability Waiver
Assumption of Risk: Sammy’s Party on Wheels LLC is committed to safety; however, the nature of our activities may carry inherent risks. By booking our services, the Client acknowledges and accepts all risks associated with the use of our equipment and event activities.
Liability Disclaimer: Sammy’s Party on Wheels LLC, including all its employees, subcontractors, and affiliates, is not responsible for any accidents, injuries, or damages that may occur during the event. The Client assumes full responsibility for all guests and attendees, and the Client agrees to release and hold harmless Sammy’s Party on Wheels LLC from any claims arising from the event.
Client’s Liability: The Client accepts all liability for damages, injuries, and accidents that may occur during the event. The Client is responsible for ensuring a safe environment for all guests and participants, and Sammy’s Party on Wheels LLC assumes no liability for incidents resulting from unsupervised or unsafe activities.
Weather Policy
Weather Uncertainty: We understand that weather can be unpredictable. If rain or inclement weather is forecasted, please notify us as soon as possible to reschedule your event.
Cancellation Due to Weather:
- Before Setup: If the event is canceled due to weather before our setup, we will be happy to reschedule to a mutually agreed-upon date, subject to availability.
- After Setup: If the event is canceled due to weather after our setup has begun, Sammy’s Party on Wheels LLC reserves the right to cancel the event if conditions become unsafe, such as during thunderstorms. No refunds are provided once the event setup has been completed.
Rescheduling: In the event of cancellation due to weather, we will make every effort to reschedule to a mutually convenient date. However, we cannot guarantee availability and do not issue refunds for weather-related rescheduling.
Equipment and Setup
Setup and Takedown: Sammy’s Party on Wheels LLC is responsible for the timely setup and takedown of all equipment. The Client agrees to provide adequate space and access for setup. Any restrictions or obstructions that prevent proper setup may result in partial services and/or additional fees.
Care of Equipment: While Sammy’s Party on Wheels LLC will maintain, clean, and inspect all equipment prior to the event, the Client agrees to use all equipment responsibly and not to modify, move, or adjust any equipment provided.
Cancellation Policy
Client-Initiated Cancellation: Cancellations must be made at least 72 hours prior to the event. Failure to provide timely cancellation will result in a forfeiture of any deposits made.
Rescheduling: Rescheduling for reasons other than weather is subject to availability and may incur a rebooking fee.
Miscellaneous Terms
Photo/Video Release: By attending a Sammy’s Party on Wheels LLC event, attendees grant permission to photograph or video their participation for promotional purposes unless otherwise specified by the Client in writing.
Agreement Amendments: Any changes or amendments to this agreement must be made in writing and agreed upon by both parties.
Acknowledgment and Agreement
By proceeding with booking, the Client acknowledges that they have read, understood, and agree to abide by the terms outlined in this Agreement to Booking and Liability Waiver. The Client accepts full responsibility for their event and agrees to release Sammy’s Party on Wheels LLC from all liability associated with their event.
